The City has received the abovementioned development (planning) application. An assessment of the development proposal found that it does not meet all of the deemed-to-comply (‘standard’) requirements of the Residential Design Codes Volume 1 Part C (‘R-Codes’).

Prior to making a decision on the application, adjoining affected owners and occupiers have been invited to view the development plans and elevations, and make comment on the planning matters that affect their property.

Matters that we would like you to consider

We ask that you consider the following matters and let us know whether you object to or support the development proposal.

Boundary walls

The R-Codes has two pathways of assessment for each clause, one being the deemed-to-comply provision which sets out clear prescriptive requirements which, if met, provide a clear pathway for approval. The other pathway for assessment is via the design principles, which are performance based and require consideration of the proposal in its context.

  • The proposed dwelling includes boundary walls along the south-western boundary.

The deemed-to-comply requirements of clause 3.4 C3.2 of the R-Codes for the zoning R40 provides for a boundary wall or multiple boundary walls with a maximum aggregate length of 2/3 of the lot boundary, which in this case is equal to 28.17m. The aggregate length of the boundary walls proposed is equal to 34.86m, and therefore exceeds the deemed-to-comply requirement by 6.69m. Accordingly, a design principles assessment is required.

  • The proposed dwelling includes boundary walls along the south-eastern boundary.

The deemed-to-comply requirements of clause 3.4 C3.2 of the R-Codes for the zoning R40 provides for a boundary wall or multiple boundary walls with a maximum aggregate length of 2/3 of the lot boundary, which in this case is equal to 15.13m. The aggregate length of the boundary walls proposed is equal to 16.08m, and therefore exceeds the deemed-to-comply requirement by 0.95m. Accordingly, a design principles assessment is required.

The proposed maximum wall lengths may be considered by the City with regard to the following design principles of clause P3.4.4 of the R-Codes:

“P3.4.4 Buildings are built up to lot boundaries where this:

  1. makes more effective use of space for primary garden areas and/or private open space;
  2. maintains adequate solar access to major openings and private open space of adjoining properties; and
  3. contributes positively to the prevailing or future development context and streetscape as outlined in the local planning framework”.

How and when to submit your comments

Please submit your comments (in writing) to the City by 5pm Thursday 10 July 2025. Where possible we ask that you submit your comments via email however your written comments may be submitted via one of the following contact methods:

How the City will make a decision on the development proposal

Following closure of this consultation period, a delegated (authorised) officer of the City will consider the abovementioned matter(s) with regard to the relevant design principle(s). As part of this process the City will also consider any comments from adjoining affected landowner(s).

Should the City issue a decision on the development application (approval or refusal), we will write to you again to address the matters you have raised.

In certain circumstances the application may be referred to the Council for consideration at one of its Council meetings. If this occurs, the City will send you a letter/email inviting you to this meeting.
