Reason for Advertising

Western Australia’s planning legislation sets out statutory consultation requirements for a range of planning matters. This allows people who may be impacted by proposals and the community in general to comment on proposals.

In this instance, the application is being advertised to owners and occupiers in accordance with the City's Local Planning Policy LP-11 – Public Consultation of Planning Proposals, as the proposal includes variations to the Residential Design Codes Volume 1; which may have the potential for the amenity of adjoining properties and the street to be impacted. You are invited to view the development plans and supporting reports (as applicable), and should you wish to, make comment on the planning matters that may affect your property.

The Residential Design Codes (R-Codes) provide a basis for the management of residential development throughout Western Australia. The R-Codes have two levels of assessment; a ‘Deemed-to-Comply’ and a ‘Design Principles’ assessment. The ‘Deemed-to-Comply’ provisions of the R-Codes are prescriptive in nature whereas the ‘Design Principles’ are more performance based. Where a proposal does not achieve the ‘deemed-to-comply’ pathway requirements, the proposal is to be considered against the relevant ‘design principles’ of the R-Codes.

Matters for Consideration

The following departures from the deemed-to-comply provisions are identified that may impact adjoining properties:

  1. Clause 5.4.2 Solar access for adjoining site

The R-Codes set out maximum overshadowing limits onto adjoining properties to achieve the deemed-to-comply requirements. The maximum overshadowing for properties coded R25 or lower is 25% of the site area to meet the deemed-to-comply pathway.

The proposal seeks approval for a maximum overshadowing of 33% of your site area and therefore seeks approval via the design principles pathway.

Please provide your written feedback to the City by 5:00pm on 4 September 2026 using the form below. You may also attach supporting documents such as plans, diagrams, or photographs.

Personal contact details such as names, email addresses and telephone numbers will not be provided to the applicant. Written submissions may be the subject of Freedom of Information requests.

In accordance with Part 8 of Local Planning Policy LP-11 – Public Consultation of Planning Proposals (Policy), if no response is received from a notified owner or occupier, the City will assume there are no comments. A lack of response will not be interpreted as either support or objection.

Guidance on what is a “valid” or “non-valid” planning consideration is provided in the Policy.

What happens following consultation?

Once the consultation period closes, a delegated officer of the City will assess the proposal, taking into account relevant planning considerations and any feedback received from affected landowners and occupiers.

If the City makes a decision on the development application (approval or refusal), we will contact you to explain how your comments were considered.

In some cases, the application may be referred to a Council meeting for determination. If this occurs, you will receive an invitation to attend or view the meeting online.
