The City has received a development application for a proposed single house.

Reason for Advertising

In this instance, the application is being advertised to owners and occupiers in accordance with the City’s Local Planning Policy LP.11 – Public Consultation of Planning Proposals, as the proposal includes variations to the Residential Design Codes Volume 1; which may have the potential for the amenity of adjoining properties and the street to be impacted.

Matters for Consideration
The following matter(s) require City's consideration:

  1. Lot boundary setback - the R-Codes set out lot boundary setback distances to achieve the deemed-to-comply requirements. The upper floor northern elevation requires a setback of 2m from the northern lot boundary.

    The proposal seeks a lot boundary setback to the upper floor northern elevation of 1.7m as assessed under the R-Codes.

  2. Visual Privacy - the R-Codes set out cone of vision distances for windows to habitable rooms. A bedroom window is to have a 4.5m cone of vision which does not extend beyond the lot boundaries to satisfy the deemed-to-comply provisions of the R-Codes.

    The cone of vision projected from the window to the master suite on the upper floor rear elevation projects over the southern lot boundary and does not achieve the deemed-comply provisions of the R-Codes.

  3. Solar Access for Adjoining Sites - the R-Codes set out maximum overshadowing limits onto adjoining properties. Developments shall be designed so its shadow cast at midday, 21 June onto adjoining properties does not exceed 25% of the site area to achieve the deemed-to-comply provisions of the R-Codes.

    The proposed development results in 33% of the adjoining property being overshadowed at midday, 21 June which does not achieve the deemed-to-comply provisions of the R-Codes.

Please provide your written feedback to the City by 5:00pm on 29 May 2026 using the form below. You may also attach supporting documents such as plans, diagrams, or photographs.

Personal contact details such as names, email addresses and telephone numbers will not be provided to the applicant. Written submissions may be the subject of Freedom of Information requests.

In accordance with Part 8 of Local Planning Policy LP-11 – Public Consultation of Planning Proposals (Policy), if no response is received from a notified owner or occupier, the City will assume there are no comments. A lack of response will not be interpreted as either support or objection.

Guidance on what is a “valid” or “non-valid” planning consideration is provided in the Policy.

What happens following consultation?

Once the consultation period closes, a delegated officer of the City will assess the proposal, taking into account relevant planning considerations and any feedback received from affected landowners and occupiers.

If the City makes a decision on the development application (approval or refusal), we will contact you to explain how your comments were considered.

In some cases, the application may be referred to a Council meeting for determination. If this occurs, you will receive an invitation to attend or view the meeting online.
