Development Application - Grouped Dwelling - DA25/0140 - 64 Burren Gate, Willetton WA 6155

The City has received the above-mentioned development application. Upon assessing the proposal, it is found that the development does not meet all of the deemed-to-comply (DTC) requirements of the Residential Design Codes Volume 1 (the ‘R-Codes’). As part of the assessment process, the City is required to exercise its discretion against the design principles to consider the variations to the R-Codes.

Prior to making a decision on the application, the adjoining affected owners and occupiers have been invited to view the development plans and elevations, and make comment on the planning matters that affect their property.

Solar Access for Adjoining Sites

The proposed dwelling will overshadow the adjoining property to a total of 159.9m2. This equates to an overshadowing percentage of 44.78% in lieu of the maximum permitted of 35%.

Out of the 44.78%, 35% of the shadowed area is occupied by the shadow cast by the upper floor.

In considering this variation, the City is required to assess the proposal against the design principles of Part 3.9, P3.9.1 of the R-Codes.

How the City will make a decision on the development proposal

Following closure of this consultation period, a delegated (authorised) officer of the City will consider the above-mentioned matter(s) with due regard to the relevant planning considerations of Schedule 2, Part 9, Clause 67 (2) of the Planning and Development (Local Planning Schemes) Regulations 2015.

In certain circumstances the application may be referred to the Council for consideration at one of its Council meetings. If this occurs, the City will send you a letter/email inviting you to this meeting.
