Scheme Amendment No.5 to Local Planning Scheme No. 42

  • The scheme amendment proposes to reclassify Lot 4 Fern Road and Lots 100 and 102 Castledare Place, Wilson from ‘Private Community Purposes’ to ‘Urban Development’.
  • The Urban Development zone requires the preparation of a Local Structure Plan before subdivision or development can proceed on a site.

Local Structure Plan

The LSP provides an analysis of site conditions and provides guidance for the future subdivision of the site:

  • an R25 density across the future residential lots,
  • access roads;
  • a shared path which creates a buffer between the reserve and the residential lots;
  • land use zones and reserves; and
  • minor variations proposed to the State Planning Policy 7.3 - Residential Design Codes

It should be noted that the Local Structure Plan document has been prepared by the applicant and the City is required to advertise the proposal within a specified time from the date of lodgement. The City has undertaken a preliminary review of the documentation and is of the view that there are some areas where further information and commitments are required, including the preparation and implementation of a Foreshore Management Plan, tree preservation assurances outlined in the Tree Protection Plan and clear actions on contamination management. These matters will be included within a detailed schedule of modifications, which will also take into account comments received during public consultation, and be presented to Council for consideration at a future Council Meeting. Council’s position will then be forwarded to the Western Australian Planning Commission who will make a decision on the LSP and scheme amendment.

Background

The WAPC gazetted the Metropolitan Region Scheme Amendment 1365/57 (MRS Amendment) relating to the Castledare Structure Plan area on 17 November 2020. The MRS Amendment formalises the boundary of the ‘Parks and Recreation’ reserve along the Canning River adjacent to Castledare, and reclassifies a portion of the ‘Parks and Recreation’ reserve adjacent to Fern Road to the ‘Urban’ zone. The MRS Amendment was the first step in the planning process for the renewal of the site. The next step of the process is an amendment to the City’s Local Planning Scheme 42 to reclassify the area to ‘Urban Development’ zone.

The City received an application for the Castledare Structure Plan (LSP) located at 14 and 16 Castledare Place, and 100 Fern Road, Wilson and the associated Local Planning Scheme Amendment No. 5. Council has initiated the above amendment to Local Planning Scheme No 42, which is being advertised for public comment in accordance with the Planning and Development (Local Planning Schemes) Regulations 2015.

Following the advertising process, both the Scheme Amendment and the LSP will be referred to Council for a final recommendation before both are referred to the Western Australian Planning Commission (WAPC) for final determination.
