Consultation has concluded

The City has received the abovementioned development application, which is briefly outlined below.

The proposal involves an internal split of the existing vacant building (ex-Bunnings) into two commercial tenancies with separate entrances and signage.

At its meeting held on 12 August 2022, the Metro Inner-South Joint Development Assessment Panel (JDAP) granted conditional approval for a change of use and additions/alterations on the same site. The JDAP approval provided for ‘Motor Vehicle’, ‘Boat and Caravan Sales’ and ‘Trade Supplies’ land uses to operate from the existing development, subject to minor works to the existing buildings to accommodate proposed operations.

The current application proposes an amendment to the previous approval, the two new businesses intended to occupy the site are BCF which is classified as a ‘Bulky Goods Showroom’ and Caravan and Camper Storage WA which is classified as ‘Motor Vehicle Boat or Caravan Sales’ under the City of Canning Local Planning Scheme 42. (LPS42)

Prior to determination of the application, adjoining affected owners and occupiers are invited to view the development plans and supporting report, and make comment on the planning matters that affect their property.

Please note that the City will endeavour to advise any tenants at this property of the above proposal; however, it may not always possible for us to contact them. This may be due to the site not having a physical post box or there being more than one tenant on the property. As the owner of the property the onus is on you to pass on this information to your tenants if it is likely that they will be impacted by the proposal.

Table 3 – Zoning Table of the City’s Scheme lists ‘Bulky Goods Showroom’ and ‘Motor Vehicle, Boat or Caravan Sales’ use as an ‘A’ (discretionary) land use in the subject ‘Centre’ zone. This means that the use is not permitted unless the local government has exercised its discretion by granting development approval after giving notice to affected landowners and occupants.

In considering an application for development approval, the local government will have regard to matters detailed in the state government’s Planning and Development (Local Planning Schemes) Regulations 2015 (Regulations 2015). In this instance the relevant matters for consideration include, but may not be limited to:

  1. The aims and provisions of the City of Canning Local Planning Scheme No. 42 (‘Scheme’) - specifically whether the proposed use meets the objectives of the subject ‘Centre’ zone, as outlined in Table 2 of the City’s Scheme.
  1. The impact on the amenity of the locality.

‘Amenity’ is defined in Schedule 1 of the Regulations 2015, as: “... all those factors which combine to form the character of an area and include the present and likely future amenity;”. Common amenity considerations include, but are not limited to, car parking and traffic generation, noise or odour emissions, and visual aesthetics.

Following closure of this consultation period, a delegated (authorised) officer of the City will consider the abovementioned matter(s) with regard to the relevant matters for consideration. This includes consideration of any comments from adjoining affected landowner(s) and occupiers.

Should the City issue a decision on the development application (approval or refusal), we will write to you again to explain how the matters you raised have been addressed. In certain circumstances the application may be referred to the Council for consideration at one of its Council meetings. If this occurs, the City will send you a letter/email inviting you to this meeting.
