What is a valid comment or objection?

    The City may only consider comments or objections that relate to valid planning considerations. The City's Local Planning Policy 11 Public Consultation of Planning Proposals (LP.11) identifies the following valid planning considerations:

    1. Matters to be considered by the City under the Planning and Development (Local Planning Schemes) Regulations 2015 Schedule 2 Clause 67 (pages 184-187); and/or   
    2. The requirements of Local Planning Scheme No.42 or an applicable Planning Instrument (Structure Plan, Local Development Plan or Planning Policy which requires the decision maker to exercise judgement; and/or   
    3. Any development standard requiring the decision maker to exercise judgement against the Design Principles of the Residential Design Codes.


    Conversely, LP.11 identifies the following matters as non-valid planning considerations:

    1. Perceived loss of property values; 
    2. Private disputes between neighbours including access & egress and easements; 
    3. Dividing fence issues; 
    4. Impact of construction work; 
    5. Trade competition concerns; 
    6. Personal morals or views about the applicant; and 
    7. Matters that is controlled under other legislation.

    What is a Development Application?

    A Development Application (DA) is an application made to Council seeking consent to carry out development including construction, demolition, change of use, display of advertising, subdivision, or making alterations or additions to a property or premises. 

    A DA is required so that Council can assess the likely impacts of the proposal.
