You are invited to provide comment on an application received for the development of Four Grouped Dwellings at the abovementioned address.

The Residential Design Codes (R-Codes) provide a comprehensive basis for the control of residential development throughout Western Australia. The R-Codes have two levels of assessment; a ‘Deemed-to-Comply’ and a ‘Design Principles’ assessment. The ‘Deemed-to-Comply’ provisions of the R-Codes are prescriptive in nature whereas the ‘Design Principles’ are more performance based.

When a development does not comply with a ‘Deemed-to-Comply’ provision of the R-Codes, and there is a possible impact on the amenity of adjoining property owners, comments may be sought by the City from those potentially impacted. Following consultation, City officers will undertake an assessment against the ‘Design Principles’ prior to determining the application. Further information on this process can be found under Volume 1 of the R-Codes which are available electronically on the Department of Planning website at https://www.wa.gov.au/government/document-collections/residential-design-codes-volume-1-including-medium-density.

With respect to the abovementioned development application, the applicant is seeking a Design Principles assessment in relation to the following:

Residential Design Codes – Volume 1

Lot Boundary Setbacks

Clause 3.4.4 – Boundary walls

Comment is sought with regards to the following:

  • Proposed aggregate boundary wall length of 39.7m instead of a maximum of 30.55m (2/3 of the length of the boundary behind the front setback) south-eastern lot boundary (adjoining HN 76 Renou Street, East Cannington).

Visual Privacy

Clause 3.10.5 – For development adjoining a vacant or unknown site

Comment is sought with regards to the following:

  • Proposed lot 3 Bedroom 1 major opening setback, within the cone-of-vision, of 3.6m instead of a minimum of 6m from the south-eastern lot boundary (adjoining HN 76 Renou Street, East Cannington); and
  • Proposed lot 3 raised Primary Garden Area setback, within the cone-of-vision, of 2.8m instead of a minimum of 3m from the north-western boundary (adjoining 72 Renou Street, East Cannington).
