The City has received a Development Assessment Panel (DAP) Application for Seven (7) Multiple Dwellings.
Reason for Advertising
Western Australia’s planning legislation sets out statutory consultation requirements for a range of planning matters. This allows people who may be impacted by proposals and the community in general to comment on proposals.
In this instance, the application is being advertised to owners and occupiers in accordance with the City’s Local Planning Policy LP.11 – Public Consultation of Planning Proposals, as the proposal includes variations to the Residential Design Codes which may have the potential for the amenity of adjoining properties and the street to be impacted. You are invited to view the development plans and supporting reports (as applicable), and should you wish to, make comment on the planning matters that may affect your property.
The Residential Design Codes (R-Codes) provide the framework for the assessment and management of residential development throughout Western Australia. Volume 2 of the R-Codes is a performance-based policy that requires development proposals to achieve the objectives of each design element.
Proposals that satisfy the relevant ‘Acceptable Outcomes’ are generally considered to meet the corresponding objectives. However, compliance with the Acceptable Outcomes is not the only means of achieving the objectives. Where a proposal does not meet an Acceptable Outcome, it must be assessed against the relevant Element Objectives to determine whether the design achieves the intended planning outcomes of the R-Codes.
Matters for Consideration The following matter(s) require City's consideration:
Lot boundary setback
The R-Codes set out lot boundary setback distances to achieve the Acceptable Outcome provisions. The building is required to have a minimum setback of 3m with an average setback of 3.5m from the side boundary to achieve the acceptable outcomes of the R-Codes.
Western Boundary - The proposal seeks a minimum setback of 2m for a portion of the ground floor (units 1 and 2) and has an average setback of 2.82m across the entire building length.
Southern Boundary - The proposal seeks a minimum setback of 3m with an average setback of 3.21m across the entire building length.
Visual Privacy
The R-Codes set out setback distances for balconies to lot boundaries to ensure visual privacy is maintained. A balcony is to have a 6m setback to achieve the Acceptable Outcomes of the R-Codes.
The balcony of Unit 7 has a setback of 3m from the side boundary and does not meet the Acceptable Outcome setback distance as assessed under the R-Codes.

What happens following consultation?
Please be advised the City is not the decision-maker for this application and the application will instead be determined by the Metro Inner Development Assessment Panel (DAP). The City’s role is to provide a recommendation to the DAP through a Responsible Authority Report. As part of preparing the City’s Responsible Authority Report to the DAP, the City is seeking your comments on the proposal.
Any comments will be included within the Responsible Authority Report to ensure that the community’s views have the opportunity to form part of the DAP’s consideration of the proposal. Information regarding the DAP process can be found on the DAP website.
