Western Australia’s planning legislation sets out statutory consultation requirements for a range of planning matters. This allows people who may be impacted by proposals and the community in general to comment on proposals.
In this instance, the application is being advertised to owners and occupiers in accordance with the City’s Local Planning Policy LP.11 – Public Consultation of Planning Proposals, as the proposal includes variations to the Residential Design Codes which may have the potential for the amenity of adjoining properties and the street to be impacted. You are invited to view the development plans and supporting reports (as applicable), and should you wish to, make comment on the planning matters that may affect your property.
The Residential Design Codes (R-Codes) provide a basis for the management of residential development throughout Western Australia. The R-Codes have two levels of assessment; a ‘Deemed-to-Comply’ and a ‘Design Principles’ assessment. The ‘Deemed-to-Comply’ provisions of the R-Codes are prescriptive in nature whereas the ‘Design Principles’ are more performance based. Where a proposal does not achieve the ‘deemed-to-comply’ pathway requirements, the proposal is to be considered against the relevant ‘design principles’ of the R-Codes.
The following departures from the deemed-to-comply provisions are identified that may impact adjoining properties:
1. Lot boundary setback
The R-Codes set out lot boundary setback distances to achieve the deemed-to-comply provisions. The building is required to have a minimum setback of 1.5m to the side boundary to achieve the acceptable outcomes of the R-Codes.
The proposal seeks a minimum setback of 1m to the south-eastern side boundary.
2. Visual privacy
The R-Codes set out overlooking cone-of-vision setback distances to achieve the deemed-to-comply provisions. Major openings to Bedrooms are required to have a minimum setback within the cone-of-vision of 4.5m to side boundaries to achieve the acceptable outcomes of the R-Codes.
The proposal shows a Bedroom window on the upper floor with a minimum setback of 4.2m to the south-eastern boundary.

How and when to submit your comments
Please submit your comments (in writing) to the City by 5pm on 26 August 2026 via the City’s Your Say Canning Page by scanning the QR code provided below.
What happens following consultation?
Following closure of this consultation period, a delegated (authorised) officer of the City will consider the abovementioned matter(s) and will consider any comments from adjoining affected landowner(s).
If the City makes a decision on the development application (approval or refusal), we will contact you to explain how your comments were considered.
In accordance with Part 8 of Local Planning Policy LP.11 – Public Consultation of Planning Proposals, if no response is received from a notified owner or occupier, the City will assume there are no comments. A lack of response will not be interpreted as either support or objection.
In some cases, the application may be referred to a Council meeting for determination. If this occurs, you will receive an invitation to attend or view the meeting online.
