Development Application - Grouped Dwelling - DA25/0114 - 23B Prince Street QUEENS PARK
Why you have received this letter.
The City has received the abovementioned development application. An assessment of the development proposal found that it does not meet all of the deemed-to-comply (‘standard’) requirements of the Residential Design Codes Volume 1 (‘R-Codes’).
Prior to making a decision on the application, adjoining affected owners have been invited to view the development plans and elevations, and make comment on the planning matters that affect their property.
Matters that we would like you to consider.
We ask that you consider the following matter(s) and let us know whether you object to or support the development proposal.
- Visual Privacy (overlooking into adjoining properties)
A window to a sitting room on the upper floor is setback 5.8m from your eastern lot boundary (common property).
Under clause 3.10 C3.10.1 of the R-Codes the window/area (which is considered to be a ‘major opening to a habitable room’) should achieve a standard setback of 6m from your lot boundary.
The proposed reduced setback may be considered by the City with regard to the following design principles of clause 3.10 of the R-Codes:
P3.10.1 Direct overlooking of major openings and active habitable spaces of adjacent dwellings and adjoining properties minimised through:
- building siting, layout and design;
- design and location of major openings;
- landscape screening of outdoor active habitable spaces; and/or
- design and location of screening devices.
P3.10.2 Adequate visual privacy achieved through appropriate interfaces between dwellings and adjoining properties including measures such as:
- offsetting the location of ground and first floor windows so that viewing is oblique rather than direct;
- building boundary walls where appropriate;
- setting back the upper storeys from the lot boundary;
- providing higher or lower windows, or windows with obscure glazing; and/or
- screening (including landscaping, fencing, timber screens, external blinds, window hoods and shutters).
P3.10.3 Visual privacy strategies maintain amenity of habitable rooms and active habitable space with regard to solar access, natural ventilation and external outlook both within the development and for adjoining properties.
